My latest review for Jotwell is up! It?s a review of Gabriella Coleman?s hot-off-the-presses new book, Coding Freedom: The Ethics and Aesthetics of Hacking. My review is titled If Code Is Law, Then Coders Are Lawyers and it praises Coleman?s perceptive, sympathetic account of how computer hackers have received, internalized, and challenged intellectual property law. What makes Coding Freedom truly stand out, however, is that ?free software hacker? is an identity significantly constituted in relation to the law. To write free software is to choose to release one?s code using a carefully crafted copyright license; Coleman?s hackers elevate this legal issue to prime significance in their working lives. Coding Freedom is thus both the oft-told story of a legal idea?free software?and the lesser-known story of how numerous hackers, following personal but parallel tracks, have engaged with copyright law.

Coleman describes two crossing trajectories in copyright: the rise of an increasingly expansive domestic and international copyright system and the simultaneous rise of the free software movement, The former is bent on restricting uses; the latter on enabling them. The two collided in the early 2000s in the fights over the implementation of the DMCA, particularly the DeCSS case and the arrest of Dmitry Sklyarov. The result was the politicization of copyright in code: inspired by legal scholars and free software evangelists, many hackers saw themselves as participants in a struggle against a repressive copyright system.

Coding Freedom makes these familiar stories fresh. Free-software hackers were receptive to a fight-for-your-rights narrative precisely because they were already embedded in a professional context that foregrounded the political and ethical implications of copyright law. What is more, they engaged with copyright law as law, drafting licenses to achieve a free-software goals, endlessly debating the minutiae of license compliance, and critiquing copyright?s inconsistencies with the playful creativity of appellate litigators.

U.S. should automatically register voters: attorney general

BOSTON/WASHINGTON (Reuters) - Attorney General Eric Holder said on Tuesday that U.S. election officials should register eligible voters automatically and take steps to reduce the long lines Americans encountered in national elections on November 6.

In a speech in Boston, Holder became the highest-ranking official to call for voting changes since President Barack Obama expressed exasperation with the hours-long lines during his re-election victory speech last night.

"Modern technology provides ways to address many of the problems that impede the efficient administration of elections," Holder said.

The United States has a patchwork election system, relying on local officials in 50 states and the District of Columbia to process the paperwork needed to register - without the use of a national ID card that some other democracies use.

Registering to vote is a necessary step to be eligible to cast a ballot in almost every U.S. state, and some jurisdictions require the paperwork weeks before Election Day.

All the paperwork is handled at the local or state level, and new paperwork is needed when someone moves.

The safeguards are in place to prevent a problem that rarely, if ever occurs, largely because few people are willing to risk felony charges to influence an election, Holder said.

"You can't get groups of sufficient numbers of people that are willing to face that possibility and try to influence an election, which is why in-person voter fraud simply doesn't exist to the extent that some on the right have said that it does," Holder told a crowd of several hundred at the John F. Kennedy Presidential Library in Boston.

REACHING 'EVERY ELIGIBLE VOTER'

Holder said the current system was needlessly complex and riddled with mistakes, resulting in 60 million adult U.S. citizens not being eligible to cast a ballot in the 2008 presidential election because they had not filed the right paperwork.

By coordinating existing databases, the government could register "every eligible voter in America" and ensure that registration did not lapse during a move, Holder said.

An overhaul would likely require approval from Congress, a significant obstacle because of the view by many Republicans that easing registration requirements could increase voter fraud.

Obama spotlighted the subject hours after winning a second four-year term. In his victory speech, he told those who waited in long lines to vote, "By the way, we have to fix that."

The U.S. Senate Judiciary Committee is scheduled to hold a hearing on "the state of the right to vote" on December 19.

Holder, as the chief U.S. law enforcement official, has limited powers to enforce voting protections.

The first black attorney general, he has called improving the system a natural extension of the civil rights movement that in the 1960s eliminated many barricades for black voters.

"The arc of American history has bent towards expanding the franchise," he said. "This generation must be true to that more inclusive history. ... it is not a time to restrict the franchise."

Holder, also recommended that polling places should have an adequate number of voting machines and be open for additional days - a challenge because thousands of local officials make those decisions independently.

"We should rethink this whole notion that voting only occurs on Tuesday, which is an agricultural notion from way back," Holder said. "Why not have voting on weekends?"

Holder declined to say how much longer he would remain in the role that he has held since 2009, though he ruled out staying for the whole of Obama's second term.

"I am not going to be the Lou Gehrig, the Cal Ripken of the Justice Department, the Janet Reno of the Justice Department, who served two full four-year terms," Holder said.

Red algae bloom closes Sydney's beaches, but probably not for long

Bloody waters before summer has even started may sound like a drag on tourism, but it's a mere drop in the sea for Australia.

Don?t worry. It?s not blood. It?s not even poisonous, just an irritant to skin and eyes and to anyone hoping for a swim now that summer?s finally about to hit Sydney.

A red algae bloom has closed 10 beaches so far in and around Sydney and up the more northerly Central Coast in Australia during the past 24 hours.?And more beach closures could be on the way, say officials. But aside from some startlingly other-world pictures, it's not likely to scare away the tourists.

The "crimson tide," or an algal bloom that has variously been compared to shark attacks or oily tomato sauce in the Aussie media, washed up on Sydney shores earlier this week, temporarily closing famed tourist beaches like Bondi. But it doesn't seem like too many around here are worried.

Turns out the blood-colored algal bloom isn?t a result of pollution, but rather an upswelling of nutrient-rich waters that the buoyant algae can feed off. Two different blooms have apparently come from the same source and essentially floated to Sydney?s shores. Their ammonia-rich diet can cause skin and eye irritations but little else problematic, according to experts.?

"This bloom has likely occurred as a result of the upwelling of nutrient-rich deep ocean water on to the continental shelf," the Metropolitan Sydney, South Coast, and Hunter Regional Algal Coordinating Committees told media Tuesday.?They said tests had identified the algae as noctiluca scintillans or "Sea Sparkle" (for its phosphorescence) and pointed out that?most algal blooms last around a week.?

Despite the closure of Sydney?s favorite beaches on the cusp of a hot summer ? and a possible heat wave of a weekend, with temperatures predicted to pass 100 Fahrenheit ? it?s doubtful this red tide will cause any longstanding problems either for locals or the tourism industry. And in the meantime, not all of Sydney's beaches are closed, and there are plenty of hotels with swimming pools.

And anyway, Australia has faced much worse in the water: Real blood in the water with the odd shark attacks, or stings from one of the many species of?box jellyfish?like the Chironex fleckeri, the world?s most venomous animal. The sting from this particular jellyfish can cause death in minutes, according to Australian jellyfish experts.

It will take much more to keep people from hitting Sydney's beaches.

Judge removed in Fort Hood shooting rampage case

FORT HOOD, Texas (AP) ? A military appeals court has thrown out a judge's order to forcibly shave the Fort Hood shooting suspect and removed the judge from the case.

The U.S. Court of Appeals for the Armed Forces ruled Monday that Col. Gregory Gross didn't appear impartial while presiding over the case of Maj. Nidal Hasan.

Hasan faces the death penalty if convicted in the 2009 shootings on the Texas Army post that killed 13 people and wounded more than two dozen.

Hasan appealed after Gross ordered that he must be clean-shaven or be forcibly shaved before the court-martial. Hasan says his beard is a requirement of his Muslim faith, but facial hair violates Army rules.

The appeals court says the command, not the judge, is responsible for enforcing grooming standards.
